For commercial work are we in NYworking from the 08 or 05 code? And what about residential. Are we still a book behind on residential?

Depends on where in NY. Many townships are the ahj some are 05 and some are 08 by me.

Residential is regulated by the Residential Code of New York State which references the 2002 NEC. Commercial electrical wiring is based on the Building Code of New York State which references the 2005 NEC. This is a statewide law and any communities who are enforcing different editions of the NEC are doing so without authorization.
