We have run into a conundrum. As would be typical, our company gives us the training but not the support with it, the manual is 2008 and the test is 2015.

We have Exam 1:

Question 4: Who is responsible for ensuring that the contract employees follow 70E work practices required by the host employer.

(we are full time on site sub contractors) (we know its A or B) I think B, can 't get an answer or manager won't ask.

A. Host employer
B: Contract Employer
C: Contract Employee
D: A qualified person.

Per Article 105 of NFPA 70E, B, the employer. Since the question is specific to NPFA 70E, that's the answer.

But as per OSHA it might also be A, the host. A company cannot subrogate the responsibility for having a safe workplace to someone else such as a contract employer. Even per NFPA 70E the OWNER OF THE EQUIPMENT is responsible for the safe use and maintenance of the equipment, and that is directly tied to the procedures that a contract employee might be asked to do. So if your contract employer tells you do do something and you are injured because the equipment was not maintained properly or there was something wrong with the installation, the owner of the equipment is not absolved of responsibility just because he hired that work out to your employer.

But again in the context of the question as asked, it's B.

Or really, as per GoldDigger's response, it's all of the above...

110.3(B)(2)

(2) The contract employer shall ensure that each of his or
her employees follows the work practices required by this
standard and safety-related work rules required by the host
employer.
