Nights lights in a restaurant?

Has anyone heard of a requirement for lights to remain on 24 hours a day in a restaurant? The requirement was stated as being a part of the State building code for Ohio with a minimum illumination level of 1.0 footcandles. I am trying to find where this requirement comes from and how to document it.

It's not an NEC requirement, but it could be a state or local requirement.
Some restaurants that I've done, had specs that required certain fixtures as 'nite lite' 24hr.
They keep the cleaning people out of a panel that uses breakers as switches, although I'd rather have switches.

I would question whether this is refering to the requirement for exit illumination at times when the building is occupied. Section 1003.2.11.1 requires 1 foot-candle at floor level for means of egress. The catch is this is only required while the building is occupied. I would question, short of local ordinance, whether the interpretation is being properly applied.
