NM cable and smoke detector question in a commercial bldg

in a commercial bldg. which will have a restaurant on the first floor and apt. on second fl. the first fl for the restaurant will be wired with mc cable can the apt be wired with nm cable the restaurant seats 104 occupants and type of construction is 111b also should the smoke dectors on this bldg. be on a deciated circuit bldg. is not going to be monitored by a fire alarm system site any code articles which may apply thank you for your help
 
Section 334.10 lists the uses permitted, I would check with your building AHJ.
For the smokes, my experience is that is done by the fire marshal, when the contractor pulls the permit, the building dept has a check list for the various requirements (fire, backflow, water, sewer) and they will indicate what is needed.
 
Just because the restaurant seats over 100 people doesn't make the entire building a place of assembly.

Many EI's will still consider anything not separated by a 1 hour or more finish from the place of assembly to still be considered part of the place of assembly though.
 
Yet most restuaraunts have ansul systems which are usually made into fire suppression, which may/may not require a dialer
