NM cable in multi unit dwellings above 3 storries

I have always understood that NM cable is not acceptable for multi unit dwellings which are 3 stories or more above ground. We have just seen a project that is a basement garage, and 4 floors above ground and they are allowing NM cable.

Did the code change or have I misunderstood all these years, is there a code section that anyone can refer me to?

There was a code change in the 2002 NEC based on the construction type not the number of floors. {334.10}
