NM in Type II Construction?

For this question I am citing NEC 2002.
Article 334
II. Installation
334.10 Uses Permitted (1,2 and 3)

Question: Can you install NM in a Type II Construction? (commercial strip mall)

I see that NM is allowed in Type III, IV, & V Type Construction which are combustible type wood buildings. Since Type II (Non Combustible Construction) is not listed, I assume that it is not permitted to be used.

I would agree with that. Also NM cable cannot be concealed in drop ceilings in other than one- and two family dwellings. Art. 334.12(A)(2)
 
I agree with Dennis. NM cable is not permitted to be installed in a building of type II construction.

it cant be exposed you can run thru steel studs just like before
just change over to mc at the top plate....

It cannot be used in Type II construction...

You have to take one more step before you can say that. If the building code would have permitted Type III, IV or V construction, and the building was built using Type I or II for some reason, then you could use NM in that building.
 
Here is a twist from the building point of view. 334.10 states that NM cable can be used in buildings "permitted" to be type II,IV or V. What happens if the building could be built as a combustible structure but the contractor chooses to use type II construction. Is NM cable now acceptable because the building could have been combustible construction? Should NM cable be allowable in areas such as currently described in 518 and say "those buildings or portions thereof that are not required to be fire-rated by the applicable building code"? Just a thought.

In this example NM could be used.
