NM sub panel feeder?

Hello,

We run the feeders to sub panels in conduit or SER cable, but I have noticed a lot of NM sub panel feeds out there lately. Out of curiosity I have tried finding the article in the code that specifies whether or not NM cable is permitted for this application but it seems a little fuzzy. Anybody know if this cable is permitted for the this application and if so maybe the code article that coincides with it? Thanks!
 
NM has limits on max size. Even if not by code, just by availability.

I don't believe I have ever seen it larger than 4 AWG.

Home Depot website shows it is available in #2. But I can't say I have ever actually seen any.

I think I have some #6 out in the garage that I bought to replace the #14 wires that currently go between my main panel and the panel in the basement. But I never got around to replacing it.

I did replace the #14 wires that ran from the basement to the garage with some larger UF. I think I ran #8. I never could figure out how they got from the basement panel out to the garage. It appears like they were just buried in the dirt somewhere.
