Non-Emergency Loads

I have a situation where an existing generator serves a single transfer switch that serves both emergency and non-emergency loads. The installation is a bit older, so I'm not sure if this was allowed back then, as I know you need to segregate the non article 700 loads onto a different transfer switch today.

My question is the client wants to add additional load on this generator. While there is capacity, the load he wishes to add is non-emergency. Is there any grandfathering type clause I could use to add the non-emergency loads to this unit, or should I recommend a separate transfer switch (even though non-emergency loads already exist on the existing transfer switch).

If you touch it at all, you will need to bring it into compliance with the current codes. But let me ask first whether you really have "emergency" loads, as defined in article 700? If so, what would they be, and can they be easily segregated onto a second ATS?

Thanks. We do have emergency loads because the generator serves all exit and egress, and elevator lighting in a 6 story facility.

They are currently serving one data room in the facility (non-emergency) from the same transfer switch. The client wants to build a second data room and serve from the same ATS/Panel.
