On Position Breaker Locks

Is it code compliant to use a set screw type breaker lock on a circuit other than Fire Alarm? I have been using them on our network circuits and a fire marshal says they have to be removed. I cannot find a code reference for this. Any help will be greatly appreciated.
 
They can be used on any circuit you want to keep from being turned off. Ask the fire marshal what his reasoning is and how a breaker lock differs from a locked panel cover.

For the past 50 years or so, all breakers listed to UL489 are trip free. This means that they will trip even though the handle is locked in the on position.
 
Ask the fire marshal for the code reference he is referring to.
Perhaps he is referring to AHJ specific to that specific city?
 
Thanks for the replies folks. I am going to reach out to the fire marshal but wanted to gather some information so I don't look like a fool. Not that I have ever let that stop me. I will post the response. This is in Laredo, TX by the way.
 
If the breaker is one that is required to be readily accessible, you cannot use a set screw type lock on device. Such a device requires the use of a tool, and if a tool is required to remove the lock and operate the breaker, the breaker is not readily accessible.
 
I use the set screw type lock but its installed without the setscrew and is only to keep the breaker from being inadvertently being turned off.
Or remove the set screw and use a thumb screw.
