One overhead electrical service for two seperate lots to have seperate services

A business has one overhead service to a switch gear which is feeding two underground fed services of two separate lots.
The electric provider will provide a separate overhead services for each lot.
Are they required to remove the conductors of the underground service from the switch gear and seal the conduit?
 
AFAIK there is no Code issue here.

May depend on who owns the service conductors? ...and CA laws. Perhaps a CA member knows more.
 
One owner owns both lots, and it seems as though he intends to rent or sale the second lot.
Safety concerns with existing conductors, and potential back feeding if reconnected.
Doesn't matter who owns the lots. What matters is who owns the conductors... perhaps... and CA laws (or possibly local ordinances may apply).

In most cases, the service point determines who owns the conductors. POCO typically don't install switchgear for services, so I'm leaning towards owner. AFAIK, he can abandon them in place if he wants to... or he can pull 'em out... his choice, as far as NEC is concerned.
