Osha and 70e

It is not clear to me if Osha inforces 70e in the work place. I don't believe they do because they came to my employers co. and nothing in electrical field came up as far as violations which we have a few. No arc flash labels at all on any electrical equipmentl.

My question is if a worker[ an electrician] were to be hurt doing electrical work and 70e wasn't followed [not in place there] as in not using the proper ppe and working hot would that be a Osha violation agaisnt the company and employee for not following 70e . I have spoken to electricians and some don't know what 70e is.

Typical. OSHA's inspections are usually looking for a specific area, not every inspector is an electrical person, obviously your wasnt. OSHA will cite 70E if an accident occurs, I would take Bill;s link to your boss and "suggest" your electrical workers get some training.

IMHO, the employer - not the employee - has the obligation.

This falls under OSHA's "General Duty" clause:
SEC. 5. Duties
(a) Each employer --

(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;

(2) shall comply with occupational safety and health standards promulgated under this Act.

29 USC 654
(b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct.
