OSHA inspection - Retroactive??

I am dealing with an OSHA inspector who has gigged us for a breaker panel in a wave generation room that has some rust on the outer cover. He is stating that in 2005 addition 680 reguires them to be uL listed. We have replaced the old and updated. We are arguing that it was installed per code 20 years ago. He is saying that the 2005 additional states it has to be a UL 4x or 6p breaker panel.

I believe that they can not go retroactive. where would I find this information.

I lokked but couldn't locate anything.
 
how does rust on a panel cover cause an OSHA violation? are we talking surface rust or is it rusted a hole all the way through? if the cover is still solid, have it bead blasted and powdercoated.

Inside of the panel looks pretty good after twenty years. Had two master elec. review the application and they stated they would install the same. State electrical inspector past it originally.

Frustrating.

To my knowledge, that's all that matters. If it was compliant when installed, it can remain.

As him how he feels about existing knob-and-tube wiring and pre-GEC NM cables.

If you PM me, I can e-mail you the OSHA regulations, updated, became effective Aug.14, 2007.

Selective retroactivity has two grandfathering time clauses. One is bfore 1972 and the other is 1981.

1910.303(b)(6) refers to that regardless of its age the equipment must be suitable for the environment. The suitablity is determined by the AHJ. UL approval is one way of determining suitability.

The general 'workmanlike manner' is one clause and that equipment needs to be properly maintained as per manufacturers instruction and good industry practice is another that the OSHA guy may use to require compliance. He should have been clearer and explanatory, rather than just: because I say so. After all it is your tax-$'s that pay his salary!:mad:
