A disconnecting means for servicing it is required.

An emergency shut off is not required for residential hot tubs.

The problem is this. The hot tub is about 50% recessed in the deck. The disco is located underneath the deck. The EC maintains that it must be in sight of the motor, which it is being underneath the deck, but you can't see it if you are in the water.
Opinions please.

Opinion - From the standpoint of accessibility, I would not want to crawl under the deck to shut or reset the GFI breaker. However, if you have to be under the deck to service the unit anyway, I guess that would be more convenient.

In my opinion it must be in sight of what you need to service

You don't service the water you service the pumps and other equipment.

Agreed, the disconnect does not need to be in sight of the water but is there to service the units electrical system.
