outlets above lay-in ceilings

I was told by an inspector that it is against code to install outlets above a lay in ceiling, if so were in the code book does it say this.

If there is a recepticle, there is a cord.

NEC 2002 Flexible Cords and Cables 400.8 Uses Not Permitted.(5)Where concealed by walls, floors, or ceilings or located above suspended or dropped ceilings.

You got it sparky. Code does not specifically prohibit the outlet above suspended ceiling, but w/o the cord what is the point? :D

I don't see anything in 400.7 that specifically permits a flexible cord above a suspended ceiling.All of the uses spec'd could be below the ceiling level. 440.8 specifically prohibits the use of flexible cord above the ceiling.

400.7 takes precedence over 400.8, because 400.8 contains specific language defering to 400.7.

400.8 "... Unless specifically allowed by 400.7..."

400.7(A)(8) specifically allows the use of some cord connected appliances.

Yes, some equipement is allowed to be cord connected. However, the equipement needs to be "listed for use as a cord connected appliance in an environmental air space" by UL and have the accompanying paper work.

Very rare.

just because there is a outlet above the ceiling does not mean there is a cord. if a 24 volt transformer is plugged into the outlet then the wire coming from it to its equipment is then low voltage wire not flexible cord so the thought that a outlet above the ceiling must have a cord plugged into it is just someone with a one track mind like my inspector. the inspector should have said the equipemt was wrong not my outlet

it would be cable not cord if it is not legal then low voltage cable for phones or data or cameras would be illegal the code book require you to have some kind of common senses.

my question was can a outlet be above a lay in ceiling it is not the inspectors place to guess at what will be plugged into it, his job is to inspect the outlet if somthing is plugged into it then the inspector can say something otherwise he needs to do his job that is to inspect not guess

Inspectors have to consider many different aspects of an electrical installation. Some of which are as follows.

110.2 Approval.
The conductors and equipment required or permitted by this Code shall be acceptable only if approved.
FPN:See 90.7, Examination of Equipment for Safety, and 110.3, Examination, Identification, Installation, and Use of Equipment. See definitions of Approved, Identified, Labeled, and Listed.

110.3 Examination, Identification, Installation, and Use of Equipment.
(A) Examination. In judging equipment, considerations such as the following shall be evaluated: (1) Suitability for installation and use in conformity with the provisions of this Code.

i understand but if there is nothing plugged in the plug then it is not his job to guess an outlet above a ceiling could be for portable that a service person uses for inspection hvac work or for a fire alarm company uses for servicing duct detectors. what i am saying is it is not against code to have a outlet above a lay in ceiling. besides how many times have you seen a building with outside security cameras , the power for there 24 volt transformer is a outlet above the ceiling that it plugs into, and store with security alarms at the door power for there 24 power is a outlet above the ceiling. til something is plugged into the outlet the inspector needs to inspect my outlet which is not agaisnt the code.
