Outside tap of unlimitted length

Per the figure shown on volume 1 of Mike's NEC 2005 book, the outside feeder taps section 240.21(B)(5) shows the outside feeder via underground. But the NEC doesn?t indicate the feeder need to be routed via underground. Can we route the feeder exposed and ?protected from physical damage?.

I think almost everyone would agree, it could be exposed, as long as it is protected. Nowhere does it say it has to be underground.
