If you have a panel that has a 10kAIC rating would the branch breakers kAIC rating in that panel HAVE to be below 10kAIC or could they be higher e.g. 42kAIC?

The breakers can be any AIC.
The panel  SCCR is based on the lowest value of any installed component.

They haven't made UL489 listed panelboard branch breakers below 10kAIC for about 60 years now.
 
Do you actually have a panelboard with a SCCR rating that low ??

I agree. Panelboards bussing is easy to support, so they typically have very high SCCR which is then limited by the AIC of installed breakers.

Now, the drawings/specifications may be showing the minimum required SCCR. The OP would have to say where the number came from.
