Panel as Pull box

I am on a project where my superviser wants to route the 2 sets of feeders from the MDP on the outside of the building, nipple out the back of the MDP into a Panel on the back side, then us that panel as a pull box feeding 2 other panels right next to it. I didn't feel like this was a very good idea but couldn't find anything in the code book... any thoughts?
 
I am also having a problem with an inspector and they are requiring me to prove that I am not using more than 40% of the cross sectional area of a panelboard. Can anyone tell me how I am supposed to show that I am not?

Measure your gutter width and depth and then multiply to get the area. Thus a 4" wide by 4" deep gutter would have 16 sq. in. 40% of 16= 6.4 sq. in. Now go to the back of the code book Chapter 9 and look at Table 5. Find the area of the wire you are using.

Say you are using #2 thhn-- thus we have an area of .1158 for this wire.

Divide .1158 into the 6.4 and you get 55 conductors in that space. Seems outrageous but I think that's correct
