Panel Change and Arc Fault protection

I have been having a discussion with a city inspector friend about Arc Fault protection on an existing house that doesn't have Arc Fault and , when built it was not required. In our area, panels can't go back in clothes closets. Panel in the closet and meter base outside right behind it. Generally what we do is remove the interior of the existing panel and make it into a junction box. We the install the new panel outside and extend the circuits to the new panel. 99% of the time it is no more than 6'. My opinion is according to article 210.12(B) exception, You do not have to install Arc Fault breakers. His opinion is that you modified the circuit so it should have Arc Fault protection. I have explained that the exception says it doesn't have to be Arc Fault protected because it is no longer than 6' and there are no devices added. Can someone give me some insight on which would be the correct way to do this.
 
Our moderator Dennis was the one that put that code change in and I am pretty sure he would agree with you and Peeetttterrr
 
I agree too but I could see this one going away at some point when the arc fault protection requirement is expanded even further.
