Can someone tell me what NEC Article prohibits a panel enclosure being used as a raceway?

One of my electricians decided to feed Panel B through Panel A (installed next to each other). Since this feeder to panel B serves an overcurrent device (MCB), 312.8 prohibits this unless the enclosure fill is 40% or less.
Is this your interpetation as well?

This is a common install, it's darn hard to overfill a panel.

Yes however there is no way it is approaching 40% fill.
