Panel feeders in seperate conduits

I have a EDP with an 8 inch trough attached to side with Emergency panel above it. The trough has two 2 inch nipples going into the emergency panel, the 3 hot legs and ground go through one and the neutral is in the other. Is there anything against code here? All the circuits for the panel also are coming through the 2 2 inch nipples.
 
To stir the pot a bit, would it still be a violation if the first nipple has the hots and neutral, and the second nipple had the grounding conductor?

Since the grounding conductor should only carry current in the event of a fault?

And even if the configuration I mentioned is still technically a violation, would it pose any specific hazard?

The existing setup can have inductive heating and eddy currents due to the difference in current in the hots and neutral.
 
If it were my choice, I'd install all of the feeder conductors in one nipple, and all of the branch circuits in the other.

Yes still a violation.

Yes, during a fault condition it can raise the total circuit impedance and slow the opening of the over current device.

The only logical choice for a number of reasons, not the least of which is derating issues if the nipples are longer then 24".
