Panel mntd to concrete

Customer is selling home. Inspector said the panel is mounted to a concrete wall in lower level. (walk out basement).
need 1/4 " air space. full basement area is heated and air conditioned. (living space) no moisture at all. walls painted with concrete w/p paint.
35 years and no corrosion at all. I cannot find code disallowing this except for damp location. Easy fix but she does not want to pay for this if not required.

Am I missing a code section?
 
I don't know what kind or how old the panel is. All residential panels that I have seen have a 1/4" raised dimple towards each corner of the panel.

I would argue that this was allowed by code when it was installed and you are not required to upgrade it.
 
The person with the comment should be the one providing the code reference.
 
All you have to do is install washers behind the panel and remove all the nonmetallic-sheathed cable installed in the basement. Should be pretty easy.
 
I agree with infinity....Prove its a wet or damp location first!

312.2 Damp and Wet Locations. In damp or wet locations, surface-type enclosures within the scope of this article shall be placed or equipped so as to prevent moisture or water from entering and accumulating within the cabinet or cutout box, and shall be mounted so there is at least 6-mm (1∕4-in.) airspace between the enclosure and the wall or other supporting surface. Enclosures installed in wet locations shall be weatherproof. For enclosures in wet locations, raceways or cables entering above the level of uninsulated live parts shall use fittings listed for wet locations.

I contend that it is indeed a DRY location.
