Allowed. If not, whats the code reference?


Panels are not prohibited from being over the stairs. If it was in the NEC it would be in Article 408

But overcurrent devices are.

240.24(F) Not Located over Steps. Overcurrent devices shall not
be located over steps of a stairway.



What about an ATS?

If it does not have overcurrent devices in it you should be fine.

If I may play semantics for a moment. Note the rule says staircase.
If you happen to have a landing which provides the proper clearances, them IMHO, the overcurrent devices could be located at the flat landing.

Whether or not it may be allowed by NEC, you also need to consider the building code and ADA.
There may be other codes that don't allow such an installation when it encroaches on clearances.

The panel cannot be over a step that is narrower than 30" per 110.26 A(2).
Also wider than 3' (or more depending on voltage) to allow for the panel and working space 110.26 A(1).
Don't forget the guarding as per 110.26 B.

Overcurrent devices shall not be located over steps of a stairway. 240.24 F.
