Panel placement in wall of fireplace

Is it code to place a sub panel recessed in the wall of the build out where the fireplace is. I'm referring to the typical Florida fire place. It's metal and they frame around it leaving the box and vent pipe away from the wood frame. Can I place the panel between the studs that box out the metal fireplace? Hope I'm explaining this correctly
 
Talk about working it hot. But seriously would that fall under 240.24 (D) somehow?

Is this metal stud around a brick fireplace, or around a metal pipe? I'd be inclined to think that anything outside the flue/fireplace is veneer and wouldnt need any special requirements.

We put receptacles and run wiring for power and comm in the brick/woodwork of fireplaces for wall mount TV. Unless I am grossly misunderstanding your proposed install, I do not see a problem putting a subpanel in the wall surrounding the fireplace. Now, if that area is expected to reach 140, 150+*, derating would most certainly kill your idea unless you wanted to massively upsize the conductors/feeder...

No brick at all just the basic metal insert then wood frame around it. The wood is about 2' away from any parts of the metal fireplace. I would think it would be fine or the wood studs would heat up just couldn't find anything in the code book.

You are probably OK. But temperatures that would not harm wood may still cause temperature problems for OCPDs.
