1st Floor 400 amp rated panel feeding into the 2nd floor 400 amp panel is this right? Or do i need to upsize my 1st floor panel to 800,also the Circuit breaker on 1st floor panel is not rated for two wires…..in each phase terminal lug.

The 400 amp 1 st floor may be adequate but you'll need to do a load calculation to ensure that it is. The two lugs per terminal may require you to change the terminals to ones listed for more than one conductor.

I can't imagine a 400 amp cb that comes with lugs for only one wire. If it does, there are likely replacement lugs available.
