nonmetallic?

Exception: Conductors installed in nonmetallic raceways
run underground shall be permitted to be arranged as isolated
phase installations. The raceways shall be installed in
close proximity, and the conductors shall comply with the
provisions of 300.20(B).

Other than service, I believe so.
 
It is my opinion that the Exception to 300.3(B)(1) is not needed as the rule in 300.3(B)(3) would permit this installation in any location. (note the CMP3 does not agree with me)
Any fastening that is ferrous and completely encircles a raceway would be an issue.
 
Thanks Don, the install was for conventional wiring to be used, after the fact I thought all 1 phase in each pipe would be
advantageous because of the ATS termination arrangement. My idea was to change the straps to aluminum and enter the open bottom of the ATS and GEAR with bell end pvc pipes. do you think it fly's.

Many AHJs only permit that when it complies with the exception to 300.3(B)(1).
