Peninsula or not?

If a peninsula has a framed knee wall below a flat counter top, is this still a peninsula?
Our local inspector says "no" and is requiring a receptacle mounted in the face of the cabinet
to satisfy 2' -4' spacing. He says this would only be a peninsula if all 3 sides are cabinet.

IMO, If the wall goes above the peninsula then I would expect to see outlets. It is still a peninsula but I think the code you refer was written for situations where there aren't many places to install one. I would say it is an ahj call. I would install receptacles if there is a place for them.

Technically you are correct but not sure you can win that one.
 
Thanks, for the reply, you're probably correct that I will not win this one.
We don't have this problem with any of the inspectors in 4 other counties, I guess 4 out of 5 ain't bad. It's too bad some times the intend of the code is missed.
 
Based on that drawing, I'm not sure how this could be anything other than a peninsula, regardless of the covering (drywall, cabinets or panels) under the countertop on the seating side. I don't think I've even seen any peninsulas with cabinets on three sides. One side is cabinets, the second the paneled end, and the third side usually bar seating. To me it sounds like he's pulling definitions out of his hat.
