I have a permanent mounted generator it has a battery charger with a 120 volt 20 amp dedicated circuit.

In discussion with a cohort he decided not to install a ground wire with the 120 volt circuit feeding the receptacle and instead bond the ground to the generator frame, so not to have a neutral ground bond.
could this possibly be a NEC violation?

Yes it is.

300.3 Conductors.
(B) Conductors of the Same Circuit. All conductors of the same circuit and, where used, the grounded conductor and all equipment grounding conductors and bonding conductors shall be contained within the same raceway, auxiliary gutter, cable tray, cablebus assembly, trench, cable, or cord, unless otherwise permitted in accordance with 300.3(B)(1) through (B)(4).
