No , I am not kidding. The heath dept. is particular about surface mounted conduits, boxes, etc...
I learned the hard way. And the resturant owner expects you as an Electrical Contractor to know all of these things.
The OP's install may be fine. But be assured there will be plenty of washing going on. And you have to be able to clean all the little creveses etc...

I have to vouch for Buck here ... the health departments are very finicky about any possible nook, cranny, crevice or unwashable surface. This would be a local health department call ... not necessarily building code or NEC.

You might very well be able to mount it behind the sink, but they may have a specific height "suggestion".
