PoE Emergency Lighting and Article 725.31(A)

Does NEC article 725.31(A) cover low-voltage emergency light fixture circuits?

I have an application where PoE lighting is being installed and a UL 924 driver bypasses the EM line voltage to allow Power over Ethernet to control the fixture.

Are the 40V leads coming from the UL 924 driver required to be in conduit?

Just like the wiring for remote heads for unit equipment, the wiring between the power source and the emergency lights must be installed in accordance with the rules found in Article 700.

Article 700 doesn't define if the wiring needs to be in conduit though. The best I definition I can find is:

700.10(C) Wiring Design and Location. Emergency wiring circuits shall be designed and located so as to minimize the hazards that might cause failure due to flooding, fire, icing, vandalism, and other adverse conditions.

Article 725.31(A) - says safety-control equipment shall be Class 1 (in conduit) if failure of the equipment introduces a "direct fire or life hazard". What constitutes a life hazard, should losing an EM light be considered a life hazard?

Very gray area, thank you for the input.
