pool and spa same area

I have a customer that wants to place their spa in side the fence area of the inground pool.
The spa will be 2 feet from the fence which will needs to be bonded. The other side will be 3 to 4 feet from the edge of the pool. The pool pump has its own 20 amp circuit. I was going to feed the spa with its own 40 amp 220 circuit. The question
is this allowed?

A quick call to your local electrical inspector would be where I would start NEC 2002 Art.80.2, also read Part IV Nec 2002 Spas and Hot Tubs. Above all remember GFCI protection.
