Pool concern

I'm finishing up an inground pool install. I get to the job this morning and I find the owner has had an invisible dog fence installed around the pool perimeter. It is about 4" away from the pool wall and encircles the entire pool.It is laying on grade and will eventually be covered by a composite deck material.

Is this a violation of wiring locations around a pool?

Any help appreciated.

For one thing, I thought the wire had to be buried to work.
 
That's a good question. My gut is to get it out of there and tell the homeowner your concern but I am not sure it is an issue. I assume there is current on the wire but it is more of a signal to the collar so I am not sure what the voltage maybe..
 
They make a wireless containment system. You just stick "flags" at various locations surrounding where you want contained/confined. I think you program a controller to each "flag". Works the same as the buried wire.
 
The wire emits RF energy which is detected by a receiver in the collar.
IMHO the only difference failure to bury the cable would make is that the receiver will trip at a greater distance on the "safe" side of the cable, which might have undesirable results.
