Pool Pump Disconnect

I have a pool installation with a 240v pump. The disconnect at the pump is a SP wall switch, properly rated.
I don't care for the fact that only 1 pole is disconnected but find no NEC violation.
Am I overlooking an appropriate Code reference ?

Controllers can break less than all lines but disconnect switches must open all ungrounded conductors.


430.103 Operation. The disconnecting means shall open
all ungrounded supply conductors and shall be designed so
that no pole can be operated independently. The disconnecting
means shall be permitted in the same enclosure with the
controller. The disconnecting means shall be designed so
that it cannot be closed automatically.
