i have an development issue related to power lines overhead in a new planned development. The question "does the code limit or prohibted power lines though the rear easement of an R3" note: the power lines are set at 40 feet

This would not be an NEC issue but rather an NESC and zoning issue. The NESC is what transmission lines and power companies would be governed by.

"R3" is a building code term, not an electrical code term. What does it mean to you? Also, what type of easement are you concerned with (e.g., electrical utility easement)?
