Power Panel Installation

Power panel has the bottom removed with a grinder and the contractor is mounting this panel flush on the concrete floor.

I have seen this install method with a larger control cabinet sitting on a housekeeping pad, but never a power panel.

Isn't this a violation of 300.10 Electrical Continuity of Metal Raceways and Enclosures?
 
The electrical continuity could be solved with a bonding jumper so I don't see an issue there. 300.12, Exception #2 permits the use of open bottom equipment. I think that there could be a 110.3(B) issue.
