Can it be used as the jumper between the indoor and outdoor unit of a mini split system without a raceway? In an office building the HVAC contractor has the TC-ER strapped with his line sets from the roof top unit down through the roof, across a suspended ceiling then through a wall to the indoor unit.

I don't think it complies with 336.12(2)

I don't even have to look it up. There are few exceptions for using TC cable outside of cable tray and none say you can without the cable being in cable tray somewhere along its run.
 
Tray cable is one of the most tested cables for durability & firespread -- exceeds the limits of NM & SER cables yet code prohibits its use in concealed spaces for all installations -- consider this, PLTC is a lesser cable can be used in class 2/3 installation yet tray cable cannot -- I would really appreciate a reason( other than NEC code & by the way UL uses the NEC as applicable uses) that using the tray cable with limits of 30V & 25A max is a life safety hazard.

There isn't one (other than what you put in parenthesis) that stands to reason.
