Anyone see any problem with an installation of this sort:

_Existing_ sub-panel rated: 200 amp.
Actual current draw: 35 amps
New Feeder Conductors:#4
New Over current Device: 3 pole 70 amp breaker

I am presenting this question because I don't think there is anything wrong with the above. Some folks in this area say it's a "nameplate violation". The only possible reason that I can come up with for this thinking on their part is 110.3(A)7. But even here I feel it's not a violation since the feeder is ok for the load.

Anyone think differently?

I don't see a problem as long as the 70 ampere overcurrent device is in the panelboard where the #4 Cu. originates. :D

I would also make sure the lugs on the 200 amp panel are rated for #4 wire. Many times the minimum wire size for lugs on 200 amp panels and loadcenters is #1.
