I have Griddle that is 9 kVA at 208V three phase. The engineer has provided 40A breaker and 50A receptacle.
FLA is 24.98A with 1.25% should give 31.22A.

Question should not the breaker be 35A instead of 40A?

As Joe said you only need to use 150% or the next standard size in your calculation. There is no 125%.

(3) Not exceed 150 percent of the appliance rated current if
the overcurrent protection rating is not marked and the
appliance is rated over 13.3 amperes.

The FLA is 24.98A. 150% of that is 37.47A. According to 422.11(E)(3) you can use 35A breaker since it satisfies the 24.98A requirement or not more than a 40A which is the next standard size above 37.47A.

It doesn't say to apply 150% and size the OCP accordingly. Only that OCP can't exceed 150% of the FLA.

The OP calls for a 40 amp circuit with a 50 amp receptacle. Are you saying that isn't code compliant or just that you're not required to use the 150%?
