Question exhaust fan wired on same circuit light

I have commercial restaurant in which restroom exhaust fan is on the same circuit as the dining room lights. Can this be done or code does not allow?

What is the HP of the fan?

The exhaust fan HP is 0.06 HP, 120V single phase. Fan itself is mounted on roof with duct supply to restroom and would be controlled with dining room light switch. Fan on roof has disconnect if that’s what you are wondering. So as long as dining room lights are on the fan would be running. The location of the light switch is in Kitchen area not accessible from restroom or dining area.

Since the fan is so small it wouldn't require an individual branch circuit so it could go on with the lighting circuit.

It's common for the fan to come on with the lights in a restaurant. It's likely a health dept requirement.
