Question on single phase 120/240 service panel

Is it legal to use a service panel that has no main breaker but supplies single phase power by feeding the buss thru a 100 2 pole breaker on one side of the buss and then pulling a 30 amp load thru a 30 amp breaker attached to the same buss within the service panel. (the 100 amp feed enters the circuit through the load side of the 2 pole breaker). This is a single outdoor feed supplying power to a railroad crossing gate system.

Does that breaker have a hold-down kit?.it is not unusual to have what appears to be a branch mounted breaker as a main..I so it will have a hold-down kit and will be labeled as a main. Normally other branch breakers are not allowed to be mounted across from it.

Yes, it is allowed. As mentioned above, you need a breaker hold down any time a breaker is backfed.

Is this a true Service according to NEC definitions? If it is not you could get rid of the 100A breaker and feed the panel using the lugs.
