(E) Receptacles in Countertops and Similar Work Surfaces in Dwelling Units. Receptacles shall not be installed in a face-up position in countertops or similar work surfaces.

IMSO, an outlet in the mantle is better than an extension cord draped in front of a fire.

Why not install it on the wall directly above the mantle.
I'm sure the HO will find something to put in front of it;)
 
Can we assume you found and inspector that wants to stir some s--- ? I agree with the others. Not saying nothing could ever run into it but unless you can come with some kinda work done on it i think its good to go. Inspectors must site number and in this case they would look stupid.
 
I don't see it as a great idea to put them there facing up - but no restriction about it - experience would say no - as I have found many no matter where they were, facing up - filled with dust bunnies. ;) (And other detritus.)
