Receptacle Above Sink in Kitchen

I have a customer who wants to install a receptacle outlet above the kitchen sink at 78"AFF for a wall-mounted TV (in a dwelling unit). Does this outlet need GFCI protection?

If it is more than 20" above the counter top I would say it is not to serve counter top surface. With that being said 210.8(A)(6) would not apply.

If you are asking if it is required to be GFCI protected look at 210.8(A)(6)
(6) Kitchens ? where the receptacles are installed to serve the countertop surfaces
So now comes the question, could this receptacle located 78 inches off the floor be considered as serving the counter top.
Let?s look and see. 210.52(C)(5) states;
(5) Receptacle Outlet Location. Receptacle outlets shall be located above, but not more than 500 mm (20 in.) above, the countertop. Receptacle outlets rendered not readily accessible by appliances fastened in place, appliance garages, sinks, or rangetops as covered in 210.52(C)(1), Exception, or appliances occupying dedicated space shall not be considered as these required outlets.
In conclusion I would say that if the countertops are 58 inches off finish floor then this receptacle will be required to be GFCI protected.
Should the countertops be 36 inches off finish floor as most are then this receptacle will not need to be GFCI protected.
I went through all this to answer your question when a simple no would have been enough.
