Receptacle box under kitchen sink, Old Gear, Thermostat

1) Is it a code violation, NEC ?, to place a receptacle outlet (for the DW/GD) directly underneath the water pipes of the kitchen sink. If the pipes leak, water intrusion may occur, NEC 110.11???

2) Is there any code that stipulates how old switchgear can be without replacing it?

3) Do the thermostat conductors running from the condensing unit to the point of entry into the building, have to be in a conduit on the outdoors?

I think 110.11 is a streatch. In my opinion it doesn't apply.

No it isn't a code violation.

And I'm not aware of any equipment age restrictions in the NEC.

the thermostat wires to the condensing unit outside are normally tie wrapped or taped to the condensate lines by the mechanical contractor
I have never seen them put into conduit of any kind look at a condensing unit on your home it is hard to find them sometimes but they are there.
