receptacles facing up

All floor mounted duplex receptacles (with receptacles facing up) that I see are poke through's with covered outlets. I have seen a standard 4"x4" box with the duplex receptacle facing up with no protection.
Code violation?

314.27(C) Floor Boxes. Boxes listed specifically for this application shall be used for receptacles located in the floor.

So a surface box may not have to be listed for this application depending on the inspectors interpretation of "in".

Any thoughts?

The concern is mainly with the idea that a floor is likely to be mopped (though there is also the question of debris entering the receptacle). Simply put, it's a bad idea to mop a receptacle!
Though a standard 4-square might technically meet code when mounted on the surface of the floor (or even in the floor, with a mud ring that raises the receptacle above the floor), the use of an outdoor box & cover, perhaps mounted on it's side, would be preferred.
Though how you're going to deal with a tripping hazard is another matter!
