Is a bathfan defined as a recessed fixture?
2009 IBC has no definition -- 713.3.2 Membrane penetrations. Membrane penetrations shall comply with Section 713.3.1. Where walls or partitions are required to have a fire-resistance rating, recessed fixtures shall be installed such that the required fire-resistance will not be reduced.

I would say that a bath fan is a recessed fixture and would be an item noted below.

MEMBRANE PENETRATION. A breach in one side of a floor-ceiling, roof-ceiling or wall assembly to accommodate an item installed into or passing through the breach.

I am not in disagreement that the bathfan shall be protected just looking for straight foward code language.
yes, a fan is a membrane penetration, which has variables for individual openings(< 16 Sq in) penetration in which protection is required. A recess can however shall be protected even though the Sq in penetration in the membrane can at times be less than required (< 16 Sq in) for protection. So to be more specific-- A bathfan penetrates a rated 1 hr ceiling and the single membrane opening is > 16 Sq in, is protecting required. Is there a code section identifies a bath fan as a recess fixture?
