Recessed lighting mounted in walls

Hi all,
a building inspector I work with is calling ECs on light fixtures not being at 6'8" above the treads on stairs leading to the basement. This requirement for height is part of the IRC and is not something I usually check. However now I do. :)

the contractor wants to put recessed lighting in the wall and mount the cans vertically, not horizontally like we are all used to seeing. In section 410 I do not see anything that would prohibit this, but from a safety standpoint this doesn't seem like a correct application.

Also so the can light installation instructions do not say that this installation is prohibited, but it doesn't say that it is acceptable either.

can you help with this dilemma? It seems that there are better solutions, but this is what the EC is asking to do.

Why not just regular step lights?
