replacing main panel w/o meeting space requirements

I'll be exchanging a 100 amp main breaker panel w/ a new panel in a location w/ a sewer pipe exceeding the width of the panel by a 8 inches below. Is it permissible to install a panel not meeting space requirements on replacement of which the rehab code will allow? Not practical to bring out panel w/o extending all cables w/ a trough.

Practicality is seldom* if not never a justification for violating Code.

If you're in New Jersey the rehab code would allow the new panel in the same place as the old one even if you did not have the clearances required for the new panel.

Thank you. As I've read of the rehab code of New Jersey, it's basically subject to damage and hazards, esp. GFI's, and tamper outlets if replaced.
