Required Main breaker?

Application is a residence. Incoming feed (400 amps) from meter comes into basement fusible disconnect. Disconnect ties to non service rated transfer switch and then to panels. A breaker is mounted in the generator that will carry the load of the house. Will a main breaker be required in the main 400 amp panel? My concern is if somebody forgot to turn off the generator breaker outside when they went to service equipment since it is not a service rated transfer switch.

This is a design issue. The NEC requires conductors, and panels, to be protected at their source. The protection may be remote from any panel. you are always able to design beyond the NEC basic requirements.
