Have an HVAC condenser with disconnect , what is the distance requirement for utilization equipment not associated with hot tub?
Will be ten feet or more from spa. Is it considered an outlet (IE disconnect)?

Ten or more feet will be fine. If you want to, you could run a bare #8 from the tubs ground bar over to the HVAC equipment just to bond it. Not necessary but not prohibited.

I will get a code section and get a minimum distance when I get home. Cant access the online NEC on this phone. I want to say that it is 5 ft if it's already bonded, but time will tell...

Not that I think it matters, however is this a single-family dwelling or other?

almost positive that he disconnect is not an outlet, however how close is the required outlet for the HVAC?

See 680.6 (2) and 680.26 (B)(7), 2008 NEC ref.. 680.40 is spas, and 680.42 outdoor installations.

A disconnect may very well be considered an outlet, tho it is not a receptacle, so you do not have to worry about it (the HVAC disco) provided it's more than 5 feet away from the inside wall / Waters Edge of the spa
