Residential above Retail stores. I seen people using 12/2 on exterior lighting for the Residential. Can't you use 14/2 for the Bedrooms and switches. And 12/2 in the Kitchen and dining as always. Their is not a code having all 12/2 Romex, Instead of the common 12/2, 14/2 installs.?

Barring any local amendments, you can wire the dwelling units per code.
There is no code stating #12 minimum conductor size in commercial installations.
