Residential Main Disconnect

We Have A Single Family Home Which Has A 400a Main Metered Pedestal With A Single 400a Main Breaker Located About 300' From The House. This Pedestal Feeds A 400a Load Center On The Front Corner Of The House. The Load Center Has Main Lugs Only With No Main Breaker. The Local Inspecter Will Not Final The House Without A Main Breaker In The Load Center. We Have Used This Application In The Past And In Different Cities And This Has Never Come Up. I Looked At The Disconnecting Means For A Residential Service But This Really Is Not A Service. I Cant Seem To Find Anything That Clearly Defines My Situation. Is This Legal? If Yes Or No Where Can I Find The Necessary Code Back Up To Either Give Up Or Pleed My Case? Please Help!!!
 
Each structure requires a disconnecting means. Look at 225.31. The inspector is correct.

Go down one section, 225.32.
 
I disagree if he has complied with article 225.31.

Now if we were talking about the service entrace conductors then I would agree. Article 230.70 the service disconnecting means shall be installed at a readily accessible location either outside of a buiding or structure or inside nearest the point of entrance of the service conductors.
 
John 225.32 requires the disconnecting means for a structure be near the structure, not 300' away at another structure.

225.32 Location.
The disconnecting means shall be installed either inside or outside of the building or structure served or where the conductors pass through the building or structure. The disconnecting means shall be at a readily accessible location nearest the point of entrance of the conductors. For the purposes of this section, the requirements in 230.6 shall be permitted to be utilized.


There are some exceptions but they do not apply to this.
 
I agree with Bob. I was just too lazy to post the Article. It's a cut and dry thing. Separate structure=disconnecting means.
